Martlet v Mulalley: Has the Court told us all we need to know about Cladding Fire Safety Claims post Grenfell?

On 14 July 2022, HHJ Stephen Davies handed down the first TCC judgment deciding claims for waking watch and remedial costs arising out of fire safety defects in the cladding to high-rise towers.  Counsel for the Claimant Housing Association, Jonathan Selby QC and Tom Coulson, will discuss the judgment and its likely impact on cladding fire safety claims post Grenfell.

Sally Davies is a partner in the Litigation and Disputes team at Mayer Brown. She is currently a member of Mayer Brown's 8 person Global Management Committee with oversight of Europe and the Middle East, having been the first woman Managing Partner of Mayer Brown's London office for 5 years.

Sally is an experienced litigator, who specialises in construction related disputes.  She advises owners, contractors, engineers and consultants, subcontractors and suppliers, as well as professionals and insurers, on all aspects of construction and engineering law. Sally has extensive experience of disputes in the construction industry including litigation, arbitration, mediation, adjudication and, more recently, her practice has led to her advising on a large number of cladding related disputes. She has resolved such disputes involving airports, sports stadia, harbour facilities, nuclear facilities, waste water treatment plants, LNG plants, motorways, mines, roads, bridges, cranes and railways, dams, office facilities, distribution centres, shopping centres, and water treatment facilities as well as traditional construction projects.

Sally is also a well-known and highly regarded industry specialist. She has served on the TeCSA committee for over 10 years and she has been a member of SCL for more years than she cares to admit.
