It is an unfortunate reality that some construction contracts are terminated by parties. When such a situation occurs, it is often the precursor to a dispute and one of the first issues is whether the contract was terminated correctly and what losses can be recovered. Despite this not being a new topic and there is relevant case law to rely upon, the termination issue remains a common area of dispute. We welcome Mathias Cheung of Atkins Chambers to provide a review of the termination process both in contract and at common law, the dos and don’ts of common issues regarding termination notices, what leads to repudiation and what amounts to acceptance of repudiation or affirmation of the contract. To explain the recoverable losses due to termination we welcome Tim Tapper from Turner and Townsend who is a quantum expert with extensive domestic and international testifying experience.
We recommend that this talk should be attended by all those that potential face such a scenario be they quantity surveyors, commercial managers, contract administrators or legal professionals.
