The judgment in Enviroflow Management v Redhill Works (Nottingham) confirmed that the Construction Act trumps the late payment legislation and brought an end to parties seeking to recover their costs within adjudication proceedings. Given the recent introduction of low cost procedures to encourage smaller disputes to be referred to adjudication, is it time for a rethink on the costs issue? In this talk, Tony Clough considers the pros and cons of the Enviroflow decision and asks whether we should allow adjudicators to award parties their costs.

Now that the Supreme Court has reached its decision in Bresco v Lonsdale, our speakers revisit the talk they gave after the first instance decision.  The talk will cover the interaction between adjudication and insolvency law, the safeguards that exist to prevent potential injustice when parties who are successful in adjudication may not have the ability to repay the sums temporarily awarded by adjudicators, and the recently confirmed ability of liquidators to adjudicate.  The speakers will also consider the practical implications, which are of immediate relevance in the current COVID (or post-COVID) climate.
