This talk will examine whether unenforceable or void liquidated damages provisions can still cap claims for general damages, and looks at the competing judicial approaches taken in Buckingham Group Contracting Limited v Peel L&P Investments and Property Limited and Eco World Ballymore Embassy Gardens v Dobler UK.
