This presentation takes a look at the meaning of "exclusive possession" and the implied term in the JCT.  There will be a review of the construction case law on third party occupation and the relevance of the Control of Horses Act 2015 as it amends the Animals Act 1971.  It will also cover "adverse" possession and the use of CPR Rule 55 and injunctions to recover possession of land from third parties.  The talk will be of interest to developers, employers, contractors and project managers and their legal advisers.
